NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON NORMAND LESSARD’S LICENCE

NOTICE is hereby given that Normand Lessard, real estate broker, licence G7847, whose establishment is located in Québec City, has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On June 19, 2024, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Lessard’s licence:


a)       Within 6 months following notification of this decision, the licence holder shall complete the training course entitled “The broker as a self-employed worker” provided by the OACIQ Training Department.

b)       Within 30 days following notification of this decision, the licence holder shall send to the OACIQ Registry Service proof of his registration for the training mentioned in paragraph a).

c)       Within 3 months following notification of this decision, the licence holder shall complete the training course "McGill Personal Finance Essentials" and send proof thereof to the OACIQ Registry Service.

d)       The licence holder shall be prohibited from carrying on real estate brokerage activities on his own account until July 15, 2027.

e)       The licence holder shall be prohibited from carrying on real estate brokerage activities within a business corporation until July 15, 2027.

f)        Until July 15, 2027, the licence holder shall maintain a written agreement with the agency on behalf of which he carries on his real estate brokerage activities, to the effect that the latter shall hold the GST/QST payable to him until he is required to remit them, upon filing of his tax return to be kept in the agency’s records.

g)       Until July 15, 2027, the licence holder shall maintain a written agreement with the agency on behalf of which he carries his real estate brokerage activities, to the effect that the latter shall hold a minimum of 25% of his remuneration for the purpose of paying his income taxes, until remittance is required upon presentation of a copy of his notices of assessment, or for the purpose of paying instalments.

h)       A copy of the agreement mentioned in paragraphs f) and g) shall be sent to the OACIQ Registry Service within 30 days following notification of this decision.

i)        In the event of an agency change during the period mentioned in paragraphs f) and g), the licence holder shall enter into a new agreement under the same conditions with the new agency, and send a copy thereof to the OACIQ Registry Service within 30 days following the agency change.

j)        The licence holder shall send to the OACIQ Registry Service proof of filing and payment of his GST/QST returns for the first two quarters of 2024 within 30 days following notification of this decision.

k)       The licence holder shall send to the OACIQ Registry Service proof of filing and payment of his subsequent GST/QST returns for 2024 and 2025 on their due dates:

-         3rd quarter 2024, October 31, 2024;
-         4th quarter 2024, January 31, 2025;
-         1st quarter 2025, April 30, 2025;
-         2nd quarter 2025, July 31, 2025;
-         3rd quarter 2025, October 31, 2025;
-         4th quarter 2025, January 31, 2026;

l)        The licence holder shall send his notices of assessment and proof of payment of his taxes by August 15, 2025 for tax year 2024, and August 15, 2026 for tax year 2025.

Should Mr. Lessard fail to comply with the above conditions and restrictions, his right to carry out professional real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

This notice became enforceable on August 13, 2024.
