NOTICE is hereby given that Mr. Jean Hugues St-Pierre, affiliated real estate agent, (Certificate No. C6913), formerly employed by or authorized to act on behalf of Re/Max Professionnel inc., chartered real estate broker (Certificate No. A3381), whose establishment is located at 1050, rue Principale in Granby, has notably been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offences summarized below:

1st count: Between August 10 and 13, 2003, with respect to an immovable, failing to ensure the protection of his client, to promote her interests and to advise and inform her with objectivity, namely by:

a) failing to include in writing in a promise to purchase that sonotubes could be inadequate under the extension, as well as the description of “a few little jobs to finish” mentioned on a detailed description sheet;

b) on or around August 12, 2003, falsely representing to a real estate agent that the immovable could not be visited before 1:00 p.m. on August 13, 2003, whereas he himself showed the immovable to other buyers on August 12, 2003;

c) failing to inform a real estate agent, in a timely manner, of the existence of a promise to purchase whereas a visit of the immovable had been agreed to for August 13, 2003 at 1:00 p.m. for a prospective buyer;

d) on August 13, 2003, during the visit, falsely representing to a real estate agent that there had been a promise to purchase on the immovable which had been accepted;

e) on August 13, 2003, failing to advise his client to take advantage of the time period indicated on a promise to purchase and to wait, before responding, for the outcome of the visit by a prospective buyer;

the whole contrary to sections 1, 24, 26 and 29 of the Rules of Professional Ethics of the ACAIQ.

2nd count: On or around August 12 and 13, 2003, with respect to an immovable, failing to give fair treatment to a prospective buyer, represented by a real estate agent, namely by:

a) on or around August 12, 2003, falsely representing to a real estate agent that the immovable could not be visited before 1:00 p.m. on August 13, 2003, whereas he himself showed the immovable to other buyers on August 12, 2003;

b) failing to inform a real estate agent, in a timely manner, of the existence of a promise to purchase whereas a visit of the immovable had been agreed to with the defendant for August 13, 2003 at 1:00 p.m.;

c) on August 13, 2003, during the visit, falsely representing to a real estate agent that there had been a promise to purchase on the immovable which had been accepted;

the whole contrary to section 24 of the Rules of Professional Ethics of the ACAIQ.

3rd count: On or around August 12 and 13, 2003, with respect to an immovable, abusing another member’s good faith, using unfair practices against him and seeking to gain an unfair advantage over him, namely by:

a) on or around August 12, 2003, falsely representing to him that the immovable could not be visited before 1:00 p.m. on August 13, 2003, whereas he himself showed the immovable to other buyers on August 12, 2003;

b) failing to inform him in a timely manner agent of the existence of a promise to purchase whereas a visit of the immovable had been agreed to with the defendant for August 13, 2003 at 1:00 p.m.;

c) on August 13, 2003, during the visit, falsely representing to him that there had been a promise to purchase on the immovable which had been accepted;

the whole contrary to section 43 of the Rules of Professional Ethics of the ACAIQ.

On February 3, 2006, the Discipline Committee ordered a suspension of Mr. Jean Hugues St-Pierre’s certificate for three periods of thirty (30) days on these counts, to be served concurrently, and to take effect whenever he applies for issuance or reinstatement of his certificate.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. March 13, 2006. The suspension of Mr. Jean Hugues St-Pierre’s affiliated real estate agent certificate will therefore become effective whenever he applies for issuance or reinstatement of his certificate, for a period of thirty (30) days.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
