NOTICE OF SUSPENSION
OF MRS. CAROLINE ROCHELEAU’S LICENCE

NOTICE is hereby given that Mrs. Caroline Rocheleau, former real estate broker (licence No. D9515) whose establishment was located in Laval, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du Courtage Immobilier du Québec of the offences summarized below:

2nd count: On or around March 10, 2008, leading others to believe that she is employed or authorized to act for a legal person that does not hold a chartered real estate broker’s certificate issued by the Association des courtiers et agents immobiliers du Québec:

a) by meeting clients in premises identified as those of the legal person;
b) by giving clients the business card of the legal person on which the statement " Caroline Rocheleau, Affiliated Real Estate Agent, Mortgage Loans" appears;
the whole contrary to the provisions of section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: On or around March 10, 2008:

a) Representing to clients that she would start the process for obtaining a financing secured by immovable hypothec in return for the payment of a sum of money;
b) In these circumstances, obtaining directly from clients a sum of $1,900 in cash;
c) Omitting to advise them that this sum of money should be deposited in a trust account;
d) Omitting to record in writing the receipt and the conditions of reimbursement of this sum of money;
Committing thus, on each occasion, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: On or around June 3, 2009, having falsely stated to the Assistant Syndic that:

a) Besides clients and herself, no other person has attended the meeting of March 10, 2008;
b) Clients did not give her any money at any time;
Committing thus, on each occasion, an offence under section 55 of the Rules of Professional Ethics of the ACAIQ.

On June 8, 2011, the Discipline Committee ordered a suspension of Mrs. Caroline Rocheleau’s real estate broker’s licence (D9515) for a period of three (3) months on count No. 2 of the complaint, a suspension for a concurrent period of three (3) months on each of counts No. 3 a), 3 b), 3 c) and 3 d), a suspension for a consecutive period of three (3) months on count No. 4 a), and a suspension for a concurrent period of three (3) months with that ordered on count No. 4 a) on count No. 4 b). These suspension periods shall be served as of the date of the appeals deadline if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

Since Mrs Caroline Rocheleau is not a licence holder, her licence will be suspended for a period of six (6) months whenever she becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences.
