NOTICE OF SUSPENSION OF
MS. MARIA AGUILAR’S LICENCE

NOTICE is hereby given that Ms. Maria Aguilar, former real estate broker (Licence No. D3665), whose establishment was located in Kirkland, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:
1st count: Concerning an immovable, did not send without delay to the manager of the place of business to which she is assigned, the information and documents required in order to maintain the records, books and registers, namely:
b) the Brokerage contract allegedly signed on December 3, 2007;
c) the Promise to purchase allegedly signed on or about March 17, 2008;
committing for each and every of the above paragraphs, an offence under section 147 of the By-law of the ACAIQ.
2nd count: After October 20, 2009, concerning an immovable, during an inquiry conducted by an Assistant Syndic, omitted, refused and/or neglected to respect her undertakings to forward him a copy of all the documents pertaining to the sale of said immovable, the whole contrary to section 54 of the Rules of Professional Ethics of the ACAIQ.
3rd count: Before on or around September 10, 2006, suggested an agreement to a buyer for the acquisition of an immovable, in order to resell it with profit, without ensuring that the terms of the said agreement were put in writing, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.
On July 2, 2014, the Discipline Committee ordered the suspension of Ms. Maria Aguilar’s real estate broker’s licence (Licence No. D3665) for a concurrent period of thirty (30) days on each of the counts Nos. 1b) and 1c), a period of thirty (30) days on count No. 2, and a period of twelve (12) months on count No. 3.
The suspension periods ordered on counts 2 and 3 will be served consecutively and concurrently with counts 1b) and 1c).
Given that Ms. Maria Aguilar is no longer a licence holder, her licence will be suspended for a period of twelve (12) months and thirty (30) days whenever she becomes a licence holder again.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
