NOTICE OF SUSPENSION
OF MRS. RIMMA ALIDZAEVA’S LICENCE

NOTICE is hereby given that Mrs. Rimma Alidzaeva, former real estate broker (licence No. D1803) whose establishment was located in Dollard-des-Ormeaux, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec of the offences summarized below:

1st count: After January 14 and/or 15, 2008, concerning an immovable, having transmitted or had someone transmitted an “Approval Summary” allegedly issued by a mortgage company to:

a) the sellers;

b) the prospective buyer;

in order to demonstrate that the prospective buyer’s mortgage request was approved, whereas she knew or should have known that it was a false document; 

committing, on each occasion, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ. 

2nd count: Between the months of January, 2008 and May, 2008, concerning an immovable, having falsely led the prospective buyers to believe that they had been approved by a mortgage lender, whereas she knew or should have known that it was false; 

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: On or about January 28, 2010, concerning an immovable, during an inquiry conducted by an assistant syndic, having falsely represented that the prospective buyers did not purchase the said immovable because there was a problem with the immovable itself and not with their financing; 

the whole contrary to section 54 of the Rules of Professional Ethics of the ACAIQ.

4th count: Concerning an immovable, having let and/or permitted another real estate agent to take from prospective buyers under false representations, the following sums:

a) on or about May 18, 2007, a sum of $8,500.00;

b) on or about May 18, 2007, a part of a sum of $29,600.00;

committing, for every and each of the above paragraphs, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

5th count: On or about October 15, 2007, concerning the acquisition of an enterprise by the prospective buyers, while she was representing a real estate broker with another real estate agent, for the selling of the said enterprise, having also represented, with him, the said prospective buyers for a promise to purchase and having permitted and/or let the other real estate agent act as lender of the financing; 

the whole contrary to section 24 of the Rules of Professional Ethics of the ACAIQ.

6th count: On or about April 30, 2008, concerning the acquisition of an immovable by the prospective buyers, while she was representing with another real estate agent, a real estate broker for the selling of the said immovable, having also represented with him, the said prospective buyers for promises to purchase and having permitted and/or let the other real estate agent’s wife act by accommodation as lender of the financing; 

the whole contrary to section 24 of the Rules of Professional Ethics of the ACAIQ.

7th count: Concerning an immovable, having indicated or let someone indicate a selling price on the following promises to purchase:

a) on or about November 25, 2007, on a promise to purchase;
b) on or about February 14, 2008, on a promise to purchase;

whereas she knew or should have known that this selling price did not represent the real selling price that the prospective buyers had agreed to pay; 

committing, for every and each of the above paragraphs, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

On June 8, 2012, the Discipline Committee ordered the suspension of Mrs. Rimma Alidzaeva’s real estate broker’s licence for a period of six (6) months on each of counts no. 1 a), 1 b) and 2 of the complaint to be served concurrently, a suspension for a consecutive period of six (6) months on count no. 3, a suspension for a consecutive period of three (3) years on count no. 4, and a suspension for a consecutive period of one (1) year on each of counts no. 5 and 6 and a period of one (1) year on count no. 7 of the complaint to be served concurrently, as of the date of the appeals deadline if she is the holder of a licence issued by the OACIQ or if not, whenever she becomes a licence holder again.

Also, the Discipline Committee ordered that the total period of suspension ordered herein be reduced by a period of seven months, in order to take into account the fact that Mrs. Rimma Alidzaeva’s real estate broker’s licence was heretofore suspended provisionally.

Given that Mrs. Rimma Alidzaeva is no longer a licence holder, her licence will be suspended for a period of five (5) years and five (5) months whenever she becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
