NOTICE OF SUSPENSION AND RESTRICTION
OF MR. STÉPHANE DESMARTEAU’S LICENCE

NOTICE is hereby given that Mr. Stéphane Desmarteau, former real estate broker (licence no. B2101), whose establishment was located in Saint-Hubert, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: As of November 2010 to March 2011, failed and/or refused to give a company the sums owed by a real estate agency under the following advance on remuneration contracts:

a) an advance on remuneration contract, signed on or around September 24, 2010, involving a real estate broker and relating to the sale of an immovable;
b) an advance on remuneration contract, signed on or around September 6, 2010, involving a real estate broker and relating to the sale of an immovable;
c) an advance on remuneration contract, signed on or around October 12, 2010, involving a real estate broker and relating to the sale of an immovable;
d) an advance on remuneration contract, signed on or around October 12, 2010, involving a real estate broker and relating to the sale of an immovable;
e) an advance on remuneration contract, signed on or around October 25, 2010, involving a real estate broker and relating to the sale of an immovable;
f) an advance on remuneration contract, signed on or around December 6, 2010, involving a real estate broker and relating to the sale of an immovable;
g) an advance on remuneration contract, signed on or around November 15, 2010, involving a real estate broker and relating to the sale of an immovable;
h) an advance on remuneration contract, signed on or around November 15, 2010, involving a real estate broker and relating to the sale of an immovable;
i) an advance on remuneration contract, signed on or around December 6, 2010, involving a real estate broker and relating to the sale of an immovable;
j) an advance on remuneration contract, signed on or around December 6, 2010, involving a real estate broker and relating to the sale of an immovable;
thus committing, on each of these occasions, an offence under Section 69 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

On December 20, 2013, the Discipline Committee ordered the suspension of Mr. Stéphane Desmarteau’s real estate broker’s licence (licence no. B2101) for a period of six (6) months on each of counts nos. 1 a) to j) of the formal complaint, to be served concurrently with each other, and a restriction of his professional activities by prohibiting him from being appointed as agency executive officer for an additional period of two (2) years subsequent to the suspension ordered above.

Given that Mr. Stéphane Desmarteau is no longer a licence holder, his licence will be suspended for a period of six (6) months followed by a restriction for a period of two (2) years whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
