NOTICE OF PERMANENT REVOCATION OF
MR. EMMANUEL PHILOSCA’S LICENCE

NOTICE is hereby given that Emmanuel Philosca, former real estate broker (Licence No. D3442), whose establishment was located in Laval, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

Count 1: As of or around December 7, 2010, concerning an immovable, following receipt of a written undertaking from a financial institution, letting or encouraging prospective buyers to engage in a real estate transaction while he knew that they have not got the down payment required to complete said transaction.

Count 2: As of or around December 7, 2010, in the course of steps undertaken for the acquisition of an immovable, appropriating or using amounts of money for purposes other than those for which they were given to him by the prospective buyers.

Count 3: During the months of May and June 2011, in the course of steps undertaken to acquire an immovable, failing to fulfill his commitments to give prospective buyers the amounts of money they had given him and to give them a certain amount of money to complete in whole or in part the down payment needed for their acquisition.

On March 12, 2015, the Discipline Committee ordered, concerning all counts listed above, the permanent revocation of Emmanuel Philosca’s real estate broker licence (Licence No. D3442) including the prohibition to request the issuance of a new licence or the reinstatement of the licence D3442, subject to the provisions of the Real Estate Brokerage Act, R.S.Q., c. C-73.2 and its regulations. The decision of the Discipline Committee is enforceable as of its notification, i.e. March 12, 2015.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
